Description LEGAL REPRESENTATION: Provides legal representation to income eligible individuals who have been arrested or summoned for a jailable offense.

INTAKE PROCEDURE:
---INCARCERATED CLIENT: Commissioners determine if the case is an eligible case and if the applicant is “indigent” based on the factors set forth in the 16-210 of the Criminal Procedure article. OPD is appointed provisionally for bail review until the qualification process is complete. Once the Applicant is determined to be eligible for OPD representation, the Commissioner’s Office notifies OPD of the requirement for representation by issuing a Qualification Certificate. The Qualification Certificate is provided to OPD Intake Depatment electronically through the PDE Portal. If a client has not seen a commissioner prior to incarceration, a family member or the client should contact the public defender’s office at: (410)-295-8800 for further instruction.


INTAKE DOCUMENTATION: These documents may be required by the Commissioner’s Office. The Public Defender’s office no longer require these documents. Clients must bring identification, case number (s), charging documents (summary of charges, summons), and verification of income for the last 30 days (2 pay stubs if paid biweekly, 4 if paid weekly). If no income, bring award letters (social security, food stamps, or other public assistance) to the interview.

Program
Eligibility Indigent persons who have committed a misdemeanor or felony criminal offence (based on income and other criteria, e.g. family size /medical bills in extreme circumstances). OPD determines eligibility of Applicants for representation in the following: o Civil and criminal contempt o VOPs (for Applicants not brought before a Commissioner; direct-commits; walk-ins) o Child in Need of Assistance Cases (CINA) or Termination of Parental Rights o Juvenile Court Cases o Court of Special Appeals Cases & Court of Appeals Cases, if not previously qualified at the trial court level o Post Conviction Cases, if not previously qualified at the trial level, appellate level, and the Applicant is no longer incarcerated. o Motions for Modification, Health General (8-505/8-507) motions (when Applicant was previously represented by private counsel) o Mental Health Cases where Applicant is committed to a mental health facility (involuntary commitment, NCR reviews, IST reviews) o Parole Retakes/Violation of Parole
