Description

Connects individuals struggling with schizophrenia spectrum, other psychotic disorders, and bipolar disorder with psychotic features, with voluntary, community-based treatment through a civil court process.

If eligible, the court may order Sacramento County’s Behavioral Health Services Division to investigate and develop a CARE Plan or Agreement tailored to the participant’s needs. Through this process, participants can receive support through the program for up to 24 months, ensuring continuity of care and ongoing access to essential services.

Program Delivery
Eligibility: Individuals who are:
1. 18 years of age or older.
2. Have a diagnosis in disorder class: schizophrenia spectrum, other psychotic disorder, or bipolar disorder with psychotic features (must include psychotic features; bipolar disorder without psychotic features is a non-qualifying diagnosis).
3. Currently experiencing behaviors and symptoms associated with severe mental illness (SMI).
4. Not clinically stabilized in ongoing voluntary treatment.
5. Unlikely to survive safely in the community without supervision or are in need of services and support to prevent relapse or deterioration that would likely result in grave disability or serious harm to the person or others.
6. Participation in a CARE Plan or Agreement is the least restrictive alternative.
7. Likely to benefit from participating in a CARE Plan or Agreement.

The following adult persons can file a petition to begin Care Court proceedings:
- Person living with the respondent.
- Family members (such as parents, siblings, grandparents, and children).
- Hospital director or designee.
- Public guardian or designee.
- Licensed behavioral health provider or designee, if services have been provided within 30 days before submitting the petition.
- Director of Adult Protective Services or designee.
- Director of California Indian Health Services Program or designee.
- Judge of a tribal court.
- Respondent (self-petition).

Application Process: File a CARE-100 form (Petition to Commence CARE Act Proceedings form) and one of the following:
- Mental Health Declaration (CARE-101 form)
- Evidence that the respondent was detained for at least two periods of intensive treatment, the most recent period within the past 60 days. Examples of evidence: a copy of the certification of intensive treatment, a declaration from a witness to the intensive treatment, or other documentation.
